Attorney advertising

This website is attorney advertising of Apparently Law PLLC, a New York professional limited liability company and law firm. It describes the legal services the firm provides and how they are priced. “Attorney Advertising” appears at the top of every page.

Apparently Law PLLC is a New York law firm whose sole member is Kale A. Pasch. It gives high-stakes legal advisory to gaming and prediction-market operators on complex, multi-state and novel-structure questions and, for operators that engage it, signs their initial legal opinions.

Nothing on this site is a guarantee, warranty or prediction about the outcome of any matter. No result in any matter can be promised, and prior results, where any are described, do not guarantee a similar outcome.

No attorney–client relationship

Using this site, requesting a review, or corresponding with us about a possible matter does not create an attorney–client relationship.

A relationship is created only when conflicts have been cleared and a written engagement letter has been signed by both you and Apparently Law PLLC. Until then, information you send us is not confidential and may not be privileged. Please do not send confidential or time-sensitive information before you have an engagement letter.

For an operator that engages it, Apparently Law PLLC is the operator’s firm of record: it signs the operator’s initial opinion and gives the operator’s ongoing advice about it, under its own engagement letter. An attorney signs every decision.

Who the firm acts for

Apparently Law PLLC does not act for a payment processor, bank or card network on any matter that concerns an operator it represents or has signed an opinion for. That includes monitoring, escalated review and change-in-law work about that operator. A processor that wants the opinion checked uses its own counsel, Apparently AI’s software, or another firm. The firm checks for conflicts before it accepts any engagement, and declines when the answer is unclear.

A payment processor, bank or card network may engage the firm as a secondary-review firm on an operator whose firm of record is another firm, if the firm has no conflict. That is a separate engagement, under its own letter.

Terms of use

These terms apply to your use of apparentlylaw.com (the “site”), which is operated by Apparently Law PLLC (“we”, “us”). By using the site you agree to them. If you do not agree, please do not use the site.

Use of the site. You may read the site, download the documents we offer for download, and share links to it. You may not use it unlawfully, interfere with it or its security, scrape it at a rate that burdens it, or misrepresent your connection to us.

No reliance. The site is general information, not legal advice (see “Not legal advice”). A document on the site, including the requirements kit, is a template for your own counsel to adapt. Do not rely on any of it without advice on your own facts.

Confidential information. Do not send us confidential information through the site or by email before an engagement letter is in place (see “No attorney–client relationship”).

Intellectual property. The text, tables, graphics, research and software on the site belong to Apparently Law PLLC or its licensors and are protected by copyright and other law. You may quote short passages with attribution and a link, and you may use the downloadable templates inside your own organisation. You may not republish or resell the site’s content, remove notices from it, or train a model on it without our written permission.

Third-party sites. The site links to other sites, including apparently.cc, Medium and Substack. We do not control them and are not responsible for their content or practices. A link is not an endorsement.

Disclaimer. The site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, completeness, timeliness or fitness for a particular purpose, to the fullest extent the law allows.

Limit of liability. To the fullest extent the law allows, Apparently Law PLLC and its members, attorneys and staff are not liable for any indirect, incidental, special, consequential or punitive loss arising from your use of the site or reliance on its content. Nothing in these terms limits liability that cannot be limited by law, or any duty we owe you under an engagement letter or the rules of professional conduct.

Governing law. These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in New York County, New York have exclusive jurisdiction over any dispute about the site, except where the law gives you the right to bring a claim elsewhere.

Changes. We may change these terms and the other notices on this page. The version and effective date are shown on each notice and its earlier versions are kept in its revision history. Continued use after a change is your acceptance of it.

Pricing information

Prices published on this site are the firm’s current fees for the services described. They are legal fees billed by Apparently Law PLLC, are not contingent on the outcome of any matter or on what an opinion concludes, and are never calculated as a percentage of a client’s or a merchant’s revenue.

The scope of your matter and the price that applies are confirmed in writing before any work begins, and are governed by your engagement letter.

Privacy

Who we are. Apparently Law PLLC is the controller of the personal information described here. You can reach us at the address at the foot of this page.

What we collect. When you write to us we receive your name, email address, the organisation you represent and what you tell us about your matter. Our servers log standard technical data, such as IP address, browser and the pages requested, so the site works and can be kept secure. We do not run analytics or advertising trackers and the site sets no cookies (see “Cookies and similar technologies”).

Why we use it. To reply to you, to assess conflicts and whether we can help, to provide services under an engagement letter, to keep the site secure, and to meet legal and professional obligations. We do not sell personal information, we do not share it for cross-context behavioural advertising, and we do not use it to profile you.

Who receives it. Service providers that host and operate the site and our email, who may use it only on our behalf, and our own attorneys and staff. If you book a call on the Contact page, Calendly receives the details you enter to schedule it. We disclose information where the law requires it or to protect legal rights. Once you engage the firm, or a processor engages it as a secondary-review firm, we receive the facts and documents you or the processor give us for that engagement, which are handled under the engagement letter and the firm’s duties of confidentiality.

How long we keep it. For as long as we need it for the purpose it was collected and to meet our professional and legal obligations, including record-keeping rules for client files.

Security. We use access controls, encryption in transit and need-to-know access. No system is perfectly secure, so please do not send confidential information before an engagement letter is in place.

Your rights. Depending on where you live, you may have the right to know what we hold about you, to correct it, to delete it, to receive a copy, and to object to or limit certain uses, including rights under California and other state privacy laws. Email us and we will respond within the time the law requires. We will not discriminate against you for exercising these rights, and we may need to verify your identity first.

Children. The site is for professionals and is not directed to anyone under 18.

Changes. If we change this notice we will update the version and date, and keep the earlier versions in the revision history.

Cookies and similar technologies

This site does not set cookies of its own and runs no analytics, advertising or tracking tools, so there is nothing to opt out of.

The one exception is scheduling. Only the Contact page schedules: it embeds Calendly’s scheduling calendar, which loads when that page opens. No other page loads anything from Calendly or from any other third party. Calendly sets its own cookies and receives your IP address and anything you enter to book, under its own privacy policy. If you never open the Contact page, nothing from Calendly loads.

The site uses the fonts already on your device and fetches none from a third party. Links to other sites, such as apparently.cc, Medium and Substack, take you to places that may set their own cookies under their own policies. Your browser lets you block or delete cookies.

If this changes, we will update this notice and its date before the change takes effect.

The firm’s legal fees are the firm’s own, set and billed by the firm under its engagement letter. Software fees are Apparently AI’s, under its terms. Neither company shares the other’s fees. Apparently AI is not a law firm and its software is not legal advice.

Payment processors use Apparently AI’s software to check an operator’s opinion in house, with their own lawyers, who make their own decisions. The firm does not take part in that check. Links from this site to apparently.cc are a disclosed affiliation, not an independent recommendation.

Apparently AI’s software gives information and tooling. Using it does not create an attorney–client relationship with the firm or with Apparently AI, and the firm does not stand behind what the software produces. Where the firm signs an opinion for you, an attorney makes the decision; no decision is made by software alone.
